1. Purpose

These terms govern the use of the Shaka service (website and mobile app) and the Premium subscription. By creating an account or subscribing, you accept these terms.

2. The service

Shaka provides rated surf forecasts (swell, wind, tides) and a recommended surfer level, for spots worldwide. Part of the service is free; some features are reserved for the Premium subscription.

3. Account

Creating an account (by email/password or via a third party like Google) is required for some features. You are responsible for keeping your credentials confidential and for the accuracy of the information provided.

4. Premium subscription, price and payment

• Price: 3,99 €/mo, including any applicable taxes.
• The subscription is monthly with automatic renewal: it renews automatically each month until cancelled.
• Secure payment via our provider Stripe (bank card, PayPal, and other offered methods). Shaka does not store your card details.
• Cancellation is possible at any time from your account (management portal). It takes effect at the end of the current already-paid period; Premium access stays active until then.
• Prices may change; any change will be notified in advance and does not apply to the already-paid period.

5. Right of withdrawal

For digital content/services supplied immediately, by subscribing and accessing the service at once, you request its immediate performance and acknowledge that you waive your 14-day right of withdrawal once access is opened (art. L221-28 of the French Consumer Code). See our refund policy.

6. Personal data

The processing of your data is described in our privacy policy.

7. Liability and safety

Forecasts, ratings and levels are indicative, derived from global weather models: they do not guarantee real conditions and replace neither your judgement nor safety guidelines at sea. Shaka cannot be held liable for any accident, injury or damage related to surfing or to the use of the information provided. The service is provided “as is”, with no guarantee of continuous availability.

8. Member-added content

Spots and content added by members remain their responsibility. Shaka may moderate, reject or remove public content. Webcam links point to third-party public pages.

9. Termination by the publisher

In case of breach (fraud, abuse, non-compliance with these terms), Shaka may suspend or close the account concerned.

10. Governing law and disputes

These terms are governed by French law. In case of dispute, you may use a consumer mediator free of charge before any legal action. Contact: [TO COMPLETE: contact email].
